What is ITAR?

The International Traffic in Arms Regulations (ITAR) are government regulations for defense and space-related exports. These regulations apply to policies and provisions for prohibited exports, imports and sales to and from specific countries. As outlined by the United States Munitions List, all exporters, manufacturers, and brokers of defense articles related to defense services and technical data must register. Examples of goods include missiles, aircraft  and design plans such as blueprints and diagrams. ITAR is specific to the United States and only U.S. citizens may access the services and products listed on the United States Munitions List (USML). This is because much of what is included on the USML is sensitive and should only be used in the best interest of the United States.

ITAR regulations are stringent and often too challenging for most manufacturers. This is mainly because any item or technology listed on the USML must be ITAR registered, including any supplies used to make that specific part. In other words, ITAR registration is easiest for companies who manufacture the part from beginning to end. For example, if a weapon was to be sold to the U.S. government, every part or component used to make that weapon should be sourced from an ITAR-registered business. For companies that outsource parts of their supply chain, this can be complicated and lead to multiple, exhaustive layers of verification.

What Happens if You are ITAR Non-Compliant?

If an ITAR-registered company falls out of compliance, they must pay significant fines and risk being removed from the United States Munitions List. Thus, it is better for an ITAR-registered manufacturer always to comply. ITAR violations can include up to $1,000,000 in fines per violation plus ten years jail time and loss of export licensing. Once registered, it is far better to be fully ITAR compliant than not.

A company may claim to be ITAR compliant, but that does not always mean taking steps to become registered. If you are producing ITAR goods, it is crucial to ensure that all suppliers in your supply chain are fully registered and following all ITAR procedures. Not only is this important to maintain ITAR registration, but it is a matter of U.S. national security.
